These Terms of Service ("Terms") govern your use of the website located at the19thhouse.com (the "Site"), operated by The 19th House ("The 19th House," "we," "us," or "our"). By visiting the Site, joining the Founders List, submitting a Founding Member deposit, or otherwise using any part of the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About This Site
The 19th House is a hospitality and recreational venue currently in development in the East Norriton, Pennsylvania area. This Site is a proof-of-concept and pre-launch informational resource. Renderings, floor plans, amenities, pricing, membership terms, and opening timelines described on the Site are concepts and estimates, not final commitments, and are subject to change as our plans develop.
2. Eligibility
You must be at least 18 years old to submit information through the Site, join the Founders List, or make a Founding Member deposit. By using the Site, you represent that you meet this requirement.
3. The Founders List
The Founders List is an optional, no-obligation email and/or SMS list for people who want early updates about The 19th House. Joining the Founders List does not create a membership, reservation, contract, or any other binding obligation on either party. We will use the contact information you provide only to send you updates about The 19th House, and we will not sell your information to third parties.
4. Text Messages and Email Communications
If you provide your mobile phone number, you consent to receive text messages from The 19th House related to Founders List updates, Founding Member details, event invitations, and related announcements. Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out of text messages, or reply HELP for assistance. Consent to receive text messages is not a condition of joining the Founders List, making a deposit, or any future purchase. You may also unsubscribe from email communications at any time using the unsubscribe link included in our emails, or by contacting us directly using the information in Section 12.
5. Founding Member Deposits
The Site may offer the option to reserve a Founding Member spot with a fully refundable deposit, currently set at $50. Submitting a deposit does not obligate you to become a member of The 19th House, and does not guarantee specific membership pricing, terms, or availability. If you request a refund, or if The 19th House does not move forward, we will process a full refund of your deposit to your original payment method. The time it takes for a refund to appear in your account may vary depending on your bank or card issuer. Full details of the current Founding Member offer are posted on the Site and may be updated from time to time.
6. Acceptable Use
When using the Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable local, state, or federal law
- Attempt to gain unauthorized access to the Site, its servers, or any connected systems
- Submit false, misleading, or fraudulent information through any form on the Site
- Interfere with or disrupt the Site's functionality, including through malware, scraping, or automated bulk submissions
- Copy, reproduce, or redistribute the Site's content for commercial purposes without our written permission
7. Intellectual Property
The Site's text, graphics, logos, renderings, and other content are owned by The 19th House or its licensors and are protected by applicable intellectual property laws. You may view and share content from the Site for personal, non-commercial purposes, but you may not otherwise copy, modify, or distribute it without our prior written consent.
8. Third-Party Services and Links
The Site uses third-party tools to operate certain features, including a chat widget and web forms provided by GoHighLevel/LeadConnector, and may in the future include a third-party payment processor (such as Stripe) for deposits. The Site may also link to third-party websites, including our social media pages. We do not control and are not responsible for the content, privacy practices, or terms of any third-party service or website. Your use of those services is subject to their own terms and privacy policies.
9. Disclaimer of Warranties
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of accuracy, merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or secure, or that the venue described on the Site will open on any particular timeline or with any particular features.
10. Limitation of Liability
To the fullest extent permitted by law, The 19th House and its founders, owners, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site will not exceed the amount, if any, you have paid to us as a Founding Member deposit.
11. Changes to These Terms
We may update these Terms from time to time as the business develops. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
12. Governing Law and Contact
